URDU 2 SHARIAH CLASSIFICATIONS OF TIME BEING SOLUTIONS (HIYAL) AND BLOCKING THE MEANS (SADD AL DHARAI) A COMPARATIVE STUDY OF FOUR SCHOOLS OF THOUGHT

Abstract

This paper is presenting the Shariah classifications of time being solutions (Hiyal) and Blocking the means (Sadd Al Dharai), it is laso discussed that  the time being solutions have very impactful history in Islamic financial times either it was the time of last prophit (PBUH) or before the start of Islam. The paper also help to understand the actual meaning/situations of Hiyal and their applications as per the principals of Islamic Law of Contract, as discussed earlier there are always a Chunk of problems that can not be treated on the basis of normal way of Islamic financial regulations because there are a lot of situations/practical scenarios/financial issues that have very different and modern class as per today's updated World, so the need of time being solutions is always there to cater above needs and to make the way possible for the believers under the supreme guidelines of Islamic Shariah. This write-up is also focused regarding main School of thoughts, Ahnaf, Malkia, Hanabila and Shafiah, it was tried that on best effort basis the time being solutions should be workable in all schools, therefore,  conclusion of each segment is mentioned. The second part of the paper contains the studies of Sadd Al Dharai, this is also very strong debate between Shariah Scholars that if the Shariah guidelines can be based on Sadd Al Dharai, the details were discussed in this paper considering the valued impact of the subject into day to day Shariah rulings. Over all this effort will help the readers, researchers and followers to understand the actual situations of Hiyal and Sadd Al Dharai and to understand the current Islamic financial system and industry in sha Allah
